Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

This article aims to contribute to the economic science’s discourse analysis, bringing the concepts of Foucault’s post-structuralism to this debate. We seek to understand the epistemological change in the economy, started in the 80s, without having to resort to a split in social interpretation in abstract cultural spheres (postmodernism) and other material-economic spheres (neoliberalism). The field of rhetoric in economics has sparked an intense debate in the social sciences. The abandonment of Keynesian theses, empirically tested throughout the 20th century, due (...) to the absorption of neoliberal theses was interpreted as an expression of “postmodernity” in economic science. Arida and Paulani’s analysis trace the methodological criticism to the intense mathematization of the economy, to the resumption of premises based on ontologically questionable abstractions without, however, understanding the role of language in structuring the discourse of economic science. It is the search for an adequate ontology that guides the methodological critique of marginalist-neoclassical economic science. Based on Foucault’s concepts, we propose a new ontology for the understanding of the rhetoric field in economics. (shrink)

Enterprise Risk Management involves the process of identification, evaluation, treatment, and communication regarding risks throughout the enterprise. To support the tasks associated with this process, several frameworks and modeling languages have been proposed, such as the Risk and Security Overlay (RSO) of ArchiMate. An ontological investigation of this artifact would reveal its adequacy, capabilities, and limitations w.r.t. the domain of risk and security. Based on that, a language redesign can be proposed as a refinement. Such analysis and redesign have been (...) executed for the risk elements of the RSO grounded in the Common Ontology of Value and Risk. The next step along this line of research is to address the following research problems: What would be the outcome of an ontological analysis of security-related elements of the RSO? That is, can we identify other semantic deficiencies in the RSO through an ontological analysis? Once such an analysis is provided, can we redesign the security elements of the RSO accordingly, in order to produce an improved artifact? Here, with the aid of the Reference Ontology for Security Engineering (ROSE) and the ontological theory of prevention behind it, we address the remaining gap by proceeding with an ontological analysis of the security-related constructs of the RSO. The outcome of this assessment is an ontology-based redesign of the ArchiMate language regarding security modeling. In a nutshell, we report the following contributions: (1) an ontological analysis of the RSO that identifies six limitations concerning security modeling; (2) because of the key role of the notion of prevention in security modeling, the introduction of the ontological theory of prevention in ArchiMate; (3) a well-founded redesign of security elements of ArchiMate; and (4) ontology-based security modeling patterns that are logical consequences of our proposal of redesign due to its underlying ontology of security. As a form of evaluation, we show that our proposal can describe risk treatment options, according to ISO 31000. Finally, besides presenting multiple examples, we proceed with a real-world illustrative application taken from the cybersecurity domain. (shrink)

RESUMO A Transferência de Embrião (TE) em bovinos se trata de uma técnica mundialmente disseminada com objetivo de aumentar a capacidade reprodutiva da fêmea. Mantém vínculo direto com outras técnicas das biotecnologias da reprodução, como, a Ovum Pick-Up (OPU), Produção In Vitro e In Vivo de embriões (PIVE) e Transferência de Embrião em Tempo Fixo (TETF), sendo estas, técnicas que fazem parte de um processo, que vai desde a seleção de doadoras, passando pelo preparo dos embriões até sua inovulação em (...) receptoras criteriosamente selecionadas. Com seu avanço, várias tecnologias de manejo vêm sendo implantadas: formas no transporte de embriões, protocolos de sincronização de doadoras e receptoras, e protocolos de recuperação de oócitos para produção de embriões. Isto infundiu a tecnologia, porém, os investimentos previstos para a produção de um animal de alto mérito genético limita sua utilização. Contudo, esta análise abordou avanços tecnológicos essenciais para o sucesso da TE, incluindo novos protocolos, sexagem de embriões, além do uso de embriões congelados Direct Transfer (DT) e vitrificados. No entanto, é claro que o sucesso do procedimento está no processo como um todo, em destaque ressalta-se que é de grande valia que o profissional apto a executar a técnica esteja sempre preparado e atualizado garantindo qualidade, eficiência e sustentabilidade na pecuária. Esta revisão foi desenvolvida com o propósito de adquirir conhecimento teórico, de forma detalhada e crítica, nas técnicas e procedimentos de Transferência de Embriões em bovinos, incluindo a colheita, manipulação e implantação de embriões. Palavras-chaves: Bovino, doadora, embrião, receptora. ABSTRACT Embryo Transfer (ET) in cattle is a globally widespread technique aimed at enhancing the reproductive capacity of females. It is closely linked to other techniques in reproductive biotechnologies, such as Ovum Pick-Up (OPU), In Vitro and In Vivo Embryo Production (PIVE), and Timed Embryo Transfer (TET), all of which are part of a process that ranges from donor selection, through embryo preparation, to their inoculation into carefully chosen recipients. With its advancement, various management technologies have been implemented: including methods for embryo transport, synchronization protocols for donors and recipients, and oocyte recovery protocols for embryo production. Although technology has been infused, the anticipated investments for producing animals of high genetic merit limit its widespread use. However, this analysis addressed essential technological advances for the success of ET, including new protocols, embryo sexing, as well as the use of frozen-thawed (DT) and vitrified embryos. Nevertheless, it is clear that the success of the procedure lies in the entire process. Notably, it emphasizes the significant value of having a qualified professional who is always prepared and updated to ensure quality, efficiency, and sustainability in livestock farming. This literary review was developed with the purpose of acquiring theoretical knowledge, in a detailed and critical way, on the techniques and procedures of Embryo Transfer in cattle, including the collection, manipulation and implantation of embryos. Resumo A transferência de embriões em bovinos tem o objetivo principal de aprimorar o melhoramento genético e otimizar a reprodução bovina A importância dessa prática é destacada pela sua contribuição para a maximização de características desejadas nos rebanhos, como qualidade de carne, eficiência reprodutiva e resistência a condições ambientais adversas. Este trabalho descreve e analisa as técnicas avançadas utilizadas nesse processo, incluindo seleção genômica, sexagem de embriões, produção in vitro, protocolos não cirúrgicos, sincronização reprodutiva, criopreservação de embriões e uso de (...) marcadores de fertilidade. A compreensão aprofundada dessas técnicas é fundamental para o sucesso da transferência de embriões, bem como para a capacidade de personalizar e aprimorar as características específicas dos rebanhos. Enfatizando a importância da expertise de profissionais especializados em reprodução bovina, este trabalho busca oferecer uma visão abrangente das práticas atuais e avanços tecnológicos nesse campo. Ao unir ciência e prática, torna-se importante a comparação de técnicas, bem como relacionar resultados eficientes para promover qualidade genética, trazer a sustentabilidade e envolver a técnica em um cenário atualizado da indústria. Palavras-chave: Embriões; Hormônio; Reprodutor. -/- Abstract Embryo transfer into cattle has the main objective of improving genetic improvement and optimizing bovine reproduction. The importance of this practice is highlighted by its contribution to maximizing desired characteristics in herds, such as meat quality, reproductive efficiency and resistance to environmental conditions adverse. This work describes and analyzes the advanced techniques used in this process, including genomic selection, embryo sexing, in vitro production, non-surgical protocols, reproductive synchronization, embryo cryopreservation and the use of fertility markers. An in-depth understanding of these techniques is critical to the success of embryo transfer, as well as the ability to customize and enhance specific herd characteristics. Emphasizing the importance of the expertise of professionals specialized in bovine reproduction, this work seeks to offer a comprehensive view of current practices and technological advances in this field. When combining science and practice, it becomes important to compare techniques, as well as relate efficient results to promote genetic quality, bring sustainability and involve the technique in an updated industry scenario. Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

This paper discusses the first incarnation of what came to be known as the “Frege-Geach” point. The point was made by Peter Geach in his 1960 essay “Ascriptivism”, and developed in “Assertion”, a 1965 piece. Geach’s articles launch a wholesale attack on theories of non-descriptive performances advanced by “some Oxford philosophers” whom he accuses of ignoring “the distinction between calling a thing ‘P’ and predicating ‘P’ of a thing”. One view that Geach specifically targets is H. L. A. Hart’s claim (...) that sentences of the form “X φ-ed” are not primarily descriptive but ascriptive of responsibility for actions. Hart explicitly accepted Geach’s criticism, and disowned his essay. I argue that he was wrong to do so. Perhaps the essay was worth retracting, but not because of Geach’s objections. I begin by restating and refining Geach’s arguments, in order to bring out the flaw he claimed to have detected in the “pattern of philosophising” that he took Hart’s essay to exemplify. I go on to argue that Geach’s original point poses no obstacle either to non-descriptivism in general, or to Hart’s sui generis non-descriptivist claim in particular. (shrink)

In Sections 1–7, I provide a detailed description of some of the advantages of theistic modal realism. The aim is to show specifically how theistic modal realism solves many of the intractable problems of philosophical theology. A detailed description of all of the advantages would require a much longer treatment. The aim is to give a good sense of the theoretical benefits that theistic modal realism affords traditional theists. I offer some concluding remarks in Section 8.

William Rowe has argued that if there is an infinite sequence of improving worlds then an essentially perfectly good being must actualize some world in the sequence and must not actualize any world in the sequence. Since that is impossible, there exist no perfectly good beings. I show that Rowe's argument assumes that the concept of a maximally great being is incoherent. Since we are given no reason to believe that the concept of a maximally great being is incoherent we (...) have no reason to believe Rowe's Argument from Improvability is sound. (shrink)

The standard position on moral perfection and gratuitous evil makes the prevention of gratuitous evil a necessary condition on moral perfection. I argue that, on any analysis of gratuitous evil we choose, the standard position on moral perfection and gratuitous evil is false. It is metaphysically impossible to prevent every gratuitously evil state of affairs in every possible world. No matter what God does—no matter how many gratuitously evil states of affairs God prevents—it is necessarily true that God coexists with (...) gratuitous evil in some world or other. Since gratuitous evil cannot be eliminated from metaphysical space, the existence of gratuitous evil presents no objection to essentially omnipotent, essentially omniscient, essentially morally perfect, and necessarily existing beings. We explore Peirce’s pragmatic conception of sign action, as a distributed and emergent view of cognition and exemplify with the emergence of classical ballet. In our approach, semiosis is a temporally distributed process in which a regular tendency towards certain future outcomes emerges out of a history of sign actions. Semiosis self-organizes in time, in a process that continuously entails the production of more signs. Emergence is a ubiquitous condition in this process: the translation of signs into signs cannot be (...) inferred from the properties of the components of a semiotic triad alone, but has to take into account a complex interaction between a micro-semiotic and macro-semiotic level of description. This interaction can be understood as an interplay of potentialities and tendencies, or upward constitutive determinative relations and downward selective determinative relations. According to this view, emergence is a central defining condition of processes of meaning. Ballet is a sign in action. The emergence of classical ballet is a self-regulatory process, in which a system of different kinds of cognitive artifacts (musical, bodily/motor, spatial/architectonic) and agents obtained a stable semiotic relation throughout many phases of development between the 16th and the 19th Century. One case is the development of the verticality of dance in classical ballet as a semiotic relation connecting proscenium arch stages, dancing bodies, and audiences. This development is micro-semiotically determined by the spatial constraints of the proscenium arch stage, and macro-semiotically determined by a historical construction of the dancing body as a sign within a network of semiotic chains, such as the intersemiotic regulation of body of the dancer by principles coming from painting. This is not only the emergence of actual meaning, but also the emergence of an open-ended field of potential and general meanings, an autonomous tendency of development. To say that ballet, as sign action, emerges, is to say that cognitive artifacts such as dancer’s bodies, stages and audience’s point of view, musical compositions, costumes, all sorts of supporting institutions, etc, constitute a niche for sign action, interacting according to tendencies of development that didn’t exist before. Perhaps the greatest impediment to a viable libertarianism is the provision of a satisfactory explanation of how actions that are undetermined by an agent's character can still be under the control of, or ‘up to’, the agent. The ‘luck problem’ has been most assiduously examined by Robert Kane who supplies a detailed account of how this problem can be resolved. Although Kane's theory is innovative, insightful, and more resourceful than most of his critics believe, it ultimately cannot account for the (...) type of control that moral responsibility and (ultimate) agency legitimately require. Sceptical theists--e.g., William Alston and Michael Bergmann--have claimed that considerations concerning human cognitive limitations are alone sufficient to undermine evidential arguments from evil. We argue that, if the considerations deployed by sceptical theists are sufficient to undermine evidential arguments from evil, then those considerations are also sufficient to undermine inferences that play a crucial role in ordinary moral reasoning. If cogent, our argument suffices to discredit sceptical theist responses to evidential arguments from evil.

Discussions of divine simplicity generally overlook the distinction between identity claims that are reductivist and identity claims that are eliminativist. If, for instance, the identity claim that 'the chair = a configuration of particles' is merely reductive, then there exist chairs and there exist configurations of particles and it turns out that they are identical. The identity in this case does not reduce the ontological complexity of the world. But if the identity claim is eliminativist, then it is true again (...) that chairs are configurations of particles, but chairs do not in fact exist. The illusory object that we call a chair turns out to be nothing over and above a configuration of physical particles. The chair reduces to the configuration of particles without remainder. The defense of divine simplicity in this paper argues that it is in this eliminativist sense that God's intrinsic properties are identical to God. (shrink)

The paper aims to show that, if S5 is the logic of metaphysical necessity, then no state of affairs in any possible world constitutes any non-trivial evidence for or against the existence of the traditional God. There might well be states of affairs in some worlds describing extraordinary goods and extraordinary evils, but it is false that these states of affairs constitute any (non-trivial) evidence for or against the existence of God. The epistemological and metaphysical consequences for philosophical theology of (...) assuming that S4 or Kσρ is the logic of metaphysical necessity are equally untenable. S4 guarantees that God does not exist if there is the slightest evidence against the existence of God. And Kσρ guarantees that God might survive the loss or acquisition of any essential property at all. (shrink)

It is commonly believed that intrinsically bad possible worlds are inconsistent with the perfect goodness of God. A perfectly good being could not exist in possible worlds that are intrinsically bad. Indeed it is widely believed that possible worlds that are insufficiently good are inconsistent with a perfectly good God. Modal atheological arguments aim to show that, since the pluriverse includes intrinsically bad worlds and insufficiently good worlds, there necessarily does not exist a perfectly good God. I show that modal (...) atheological arguments are in general invalid. Modal atheological arguments fail to show that there exists no perfectly good God even on the assumption that there are extremely bad worlds in the pluriverse. Modal atheological arguments depend entirely on the logic of modality in S5. But the logic of S5 ensures that a perfectly good God is consistent with extremely bad possible worlds and so guarantees that a perfectly good God is consistent with a plenitudinous pluriverse. The minimal God exemplifies essential omnipotence, omniscience, and moral perfection, but none of the other properties of the traditional God. I examine the consequences of the minimal God in augmented S5, S4, and Kρσ. The metaphysical consequences for the minimal God in S5 include the impossibility that God—or any other object—might acquire, lose, or exchange an essential property. It is impossible that an essentially divine being might become essentially human, for instance. The epistemological consequences include the impossibility of agnosticism—it is (...) impossible that P(◻︎FG |E) = P(~◻︎FG| E). Indeed, every weaker forms of agnosticism are also impossible—it is impossible that P(◻︎FG |E) = n, n(0 < n < 1). The metaphysical and epistemological consequences for the minimal God in S4 are equally untenable. I show that we can avoid all of these unwelcome epistemological consequences for the minimal God in Kρσ. But Kρσ has some extraordinary metaphysical consequences for the minimal God. All of the problems for the minimal God generalize to the maximal God. (shrink)

The main aim in the forthcoming discussion is to contrast theistic modal realism and theistic actualist realism. Actualist realism is the dominant view among theists and presents the most serious challenge to theistic modal realism. I discuss various prominent forms of theistic actualist realism. I offer reasons for rejecting the view of metaphysical reality that actualist realism affords. I discuss theistic modal realism and show that the traditional conception of God is perfectly consistent with the metaphysics of genuine modal realism. (...) A Crítica de Hume ao Argumento do Desígnio José Oscar de Almeida Marques Dep. de Filosofia – UNICAMP -/- RESUMO: É comum considerar que o chamado “argumento do desígnio” (o argumento a posteriori para provar a existência de Deus a partir da ordem e funcionalidade do mundo) teria sido refutado ou seriamente abalado por Hume. Mas a natureza e o alcance dessa alegada refutação são problemáticos, pois Hume muitas vezes expressou suas críticas através de seus personagens e evitou assumi-las (...) diretamente enquanto autor. Em vez de supor que Hume procedeu dessa forma apenas para disfarçar suas verdadeiras convicções e evitar um conflito com as autoridades eclesiásticas, proponho que sua posição nesse assunto não é tão categórica como às vezes se supõe, e que os famosos argumentos de Filo nos Diálogos mostram apenas que é possível que a ordem e funcionalidade do mundo tenham surgido sem a intervenção de um desígnio consciente, mas não podem por si sós dar a essa hipótese o mínimo grau de plausibilidade necessário para torná-la digna de uma séria consideração. De fato, antes da revolução explicativa operada por Darwin um século depois, ninguém estava realmente em condições de vislumbrar uma alternativa plausível à atuação de algum tipo de inteligência na geração da ordem e funcionalidade do mundo. ------------ Some Remarks on Hume’s Critique of the Argument from Design José Oscar of Almeida Marques Dep. of Philosophy - UNICAMP -/- ABSTRACT: The so-called “argument from design” (the a posteriori argument to prove the existence of God from the order and functionality of the world) is commonly considered to have been refuted or seriously impaired by Hume. But the nature and scope of this alleged refutation is problematic because Hume often expressed his critics through other characters’ mouth and avoided to assume them directly as author. Contrarily to the supposition that Hume proceeded in this way only to disguise his true convictions and to avoid a confrontation with the ecclesiastical authorities, I propose that his stance on the matter is not, in fact, as clear-cut as it is sometimes supposed, and that Philo’s famous arguments in the Dialogues show only that it is possible for the order and functionality of the world to have arisen without the intervention of an intelligent design, but cannot by themselves lend to this hypothesis the least degree of plausibility needed to make it worthy of serious consideration. In fact, before the explanatory revolution inaugurated by Darwin a century later, nobody was in position to envisage a plausible alternative to the operation of some sort or other of intelligence in the generation of the order and functionality of the world. In this paper we respond to criticisms by Michael Bergmann and Michael Rea in their “In Defense of Sceptical Theism : A Reply to Almeida and Oppy,” Australasian Journal of Philosophy 83.

I examine the difficulties involved in the Aristotelian proposal to identify the knowledge of “what it is” and “why it is”, in order to better understand the outlines that delimit it. I propose that the connections by which Aristotle links definition and explanation, and hence essence and cause, depend on the mutual convertibility between nominal expressions and predicative sentences.

La obra es un estudio de una de las nociones fundamentales en la filosofía de Gadamer, el concepto de aplicación. Se intenta dar cuenta de la manera en que dicho concepto viene a solucionar, o tal vez sería mejor decir, a disolver, en la reflexión del siglo XX, el problema que enfrentaban las ciencias históricas en el siglo XIX para convertirse en conocimiento objetivo. Dicho problema consistía en dos importantes dificultades vinculadas entre sí: la imposibilidad de disponer de un objeto (...) independiente, el pasado “tal cual ocurrió” para confrontar la adecuación de las visiones del mismo constituidas desde el presente, por un lado, y la imposibilidad de erradicar la perspectiva del presente (intereses, ideologías, etc.)en los relatos históricos. Para abordar este problema, Gadamer acomete nada menos que una revisión de las categorías fundamentales en las cuales se inserta esta dificultad, esto es, las nociones de conocimiento, realidad y verdad modeladas, a través de Kant, de acuerdo a la perspectiva de la moderna ciencia de la naturaleza. Un paso fundamental será entonces examinar el problema del valor cognitivo del arte, esto es, elucidar las nociones de realidad y experiencia a partir de la experiencia artística, para extender luego estas conclusiones a la historia y el lenguaje. En el marco de esta revisión se perfila el concepto de aplicación, el cual destaca que nuestra condición de agentes históricos, insertos en una tradición y en una comunidad lingüística, no es un obstáculo, sino justamente la condición que hace posible que podamos comprender lo diferente a lo propio, ya sea en la forma de la alteridad histórica, lingüística o meramente personal. La tesis de la obra que presentamos es que la estructura de la aplicación, con la consecuente historicidad que acarrea, se presenta de manera semejante tanto en las macro-estructuras de la comprensión (comprensión de textos, de la tradición, del arte) como en las estructuras de un nivel inferior o más básico, como la realización de juicios y la comprensión de conceptos, punto que se elabora, en esta obra, a través de una comparación con las ideas del segundo Wittgenstein. (Manuscript draft accepted for publication in 2024 by 'Research in Phenomenology') The purpose of this essay is to diffract ressentiment through decolonial theory. I would like to see what sort of light this sheds on the psychological undercurrents that impose barriers on colonial and decolonial thought, as well as on the conceptual dynamism of ressentiment. This essay is split into two different experiments in thought. The first will be to diffract ressentiment through the works of Gloria Anzaldúa, Édouard Glissant, and (...) Gilles Deleuze. To this end, I will begin by providing an analysis of ressentiment as developed by Nietzsche in On the Genealogy of Morals and then supplement this with Deleuze’s analysis of ressentiment in Nietzsche & Philosophy. I will create a bridge with decolonial thought by interpreting Anzaldúa’s concept of the nopal de castilla and mestiza consciousness through the interpretive lens of ressentiment to show the affinity that exists between the work of Anzaldúa and Nietzsche. I will finish the first experiment by looking at ressentiment through some of the concepts Glissant offers us in the Poetics of Relation. In particular, I will argue that ressentiment resists the creolization of identity and culture, and that Glissant’s demand for the right to opacity for all is the sign of a thinking that has overcome ressentiment. The second experiment is to diffract ressentiment through Eduardo Viveiros de Castro’s Cannibal Metaphysics, beginning with an analysis of the most relevant points of that text for our discussion then putting our diffracted version of ressentiment in conversation with Amerindian perspectivism. However, this does not mean that I am aiming at a synthesis of ressentiment with Amerindian perspectivism. Rather, in the spirit of the Brazilian author’s post-structural anthropology, this essay sees only a disjunctive synthesis of the two: a ressentiment becoming-Amerindian perspectivism and an Amerindian perspectivism-becoming-ressentiment (we will focus on developing the former). I hope that, by the end of this experiment, we may have a richer conceptual understanding of ressentiment by offering this concept an image of itself that only our decolonial thinkers and an Amerindian perspective can reveal. I provide the account of divine creation found in multiverse theorists Donald Turner, Klaas Kraay, and Tim O’Connor. I show that the accounts Kraay and Turner offer are incoherent. God does not survey all possible worlds and necessarily actualize those universes in the (on balance) good worlds or the worthy worlds. If God necessarily actualizes the multiverse, we have no idea which universes are parts of that multiverse. I show next that Tim O’Connor’s multiverse account of creation is also incoherent. (...) I argue that a preferable multiverse would include a much greater variety of universes than are included in Turner, Kraay or O’Connor. In the last section I offer some concluding remarks. (shrink)

The following paper puts the history of race and colonialism in conversation with the history of the concept of energy. The objective is to understand what a critical decolonial perspective can teach us about the central role that energy plays in western culture, materially and epistemologically. I am interested in how this approach to political, epistemological, and ontological questions demands that we reconceptualize energy to account for the historical particularity of the concept and the phenomena of history and intersubjectivity, which (...) are eschewed in a purely materialistic and quantitative conception of energy. We will see how energy has been complicit in the racialization of black and indigenous bodies, and how the privileged place that the concept of energy has occupied in the canon of western physics has served to obscure the theological, metaphysical, and cultural assumptions that constitute it. No presente trabalho, com vistas para uma análise conceitual e crítica acerca do modelo de democracia representativa, bem como uma proposta de mudança sistemática e ordenada, iremos nos debruçar sobre os conceitos e perspectivas elencadas por Arendt e Bobbio no cerne da questão participativa. Hannah Arendt (1941-1975), ilustre teórica política, compreende a sociedade consolidada pós revoluções americana e francesa como fortemente apolitizada, visto o afastamento dos cidadãos dos assuntos públicos na atual democracia indireta. Norberto Bobbio (1909-2004), renomado jusfilósofo, define com (...) rigor analítico a categoria representativa da participação popular nas questões coletivas, indicando suas limitações e possibilidades. Em vista disso, faz-se necessário o estudo conjunto de ambas personalidades para o entendimento da disposição comum no que diz respeito à representatividade política que, segundo a autora alemã, impede a efetiva realização da vida cívica e atomiza os sujeitos, suscitando o desinteresse pela coisa pública e facilitando a oligarquização da mesma. A partir da inferência no que se refere ao foco central deste artigo, e da investigação complementar sobre os próprios riscos da implementação excessiva dos cânones reverberados pela tradição antiga — a qual pressupõe o envolvimento direto dos cidadãos no governo —, perpassaremos pela alternativa proposta por Arendt, a saber: a criação de conselhos deliberativos nos diversos níveis subnacionais a fim de fomentar o maior interesse e atuação popular na tomada de decisões, salvaguardando, assim, parte significativa do espírito revolucionário mas, sem retirar a centralidade de um governo bem estabelecido. Dessa maneira, a relação entre Arendt e Bobbio se designará no exame do sistema democrático representativo com respeito às limitações impostas pelo próprio sistema que impede a plena participação popular qualitativa, juntamente com a orientação arendtiana para rarear essa problemática — embora sem buscar a completa aniquilação do mecanismo de partidos, mas a união deste com o modelo de conselhos. Der Denkweg Hegels kann als ein Bildungsprozess von Einheitsbegriffen angesehen werden. Dieser Weg lässt sich in zwei Phasen einteilen: eine spekulative und eine vorspekulative Phase. Die These dieses Aufsatzes besteht darin, dass der Begriff der Einheit sich innerhalb beider Phasen jenes Denkweges entwickelte und dabei die gleichen allgemeinen Formen annimmt. Von daher kann der Weg dieses Denkens durch einen Doppel-Begriff, den der spekulativen und den der vorspekulativen Einheit, rekonstruiert werden. Im Blick auf das Ganze lässt sich also sagen, dass beide (...) Phasen am Ende durch die fundamentale Entscheidung Hegels eines „Eingreifens in das Leben der Menschen“ verbunden sind. Und die letzte Form der Einheit in der spekulativen Phase – die der absoluten Idee – wird dementsprechend eine gewisse aufgehobene Bewegung der Subjektivität und der Objektivität sein, an der sich die Einheit als Freiheit zeigt. In debates concerning the consequence argument, it has long been claimed that [McKay, T. J., and D. Johnson. 1996. “A Reconsideration of an Argument Against Compatibilism.” Philosophical Topics 24 (2): 113–122] demonstrated the invalidity of rule (β). Here, I argue that their result is not as robust as we might like to think. First, I argue that McKay and Johnson's counterexample is successful if one adopts a certain interpretation of ‘no choice about’ and if one is willing to deny the (...) conditional excluded middle principle. In order to make this point I demonstrate that (β) is valid on Stalnaker's theory of counterfactuals. This result is important and should not be neglected, I argue, because there is a particular line of objection to the revised formulations of the consequence argument that does not succeed against the original version. Political liberals ask citizens not to appeal to certain considerations, including religious and philosophical convictions, in political deliberation. We argue that political liberals must include a demanding requirement of intellectual modesty in their ideal of citizenship in order to motivate this deliberative restraint. The requirement calls on each citizen to believe that the best reasoners disagree about the considerations that she is barred from appealing to. Along the way, we clarify how requirements of intellectual modesty relate to moral reasons for (...) deliberative restraint. And we argue against attempts to weaken our requirement of intellectual modesty by emphasizing those moral reasons. (shrink)

Nick Trakakis and Yujin Nagasawa criticise the argument in Almeida and Oppy . According to Trakakis and Nagasawa, we are mistaken in our claim that the sceptical theist response to evidential arguments from evil is unacceptable because it would undermine ordinary moral reasoning. In their view, there is no good reason to think that sceptical theism leads to an objectionable form of moral scepticism. We disagree. In this paper, we explain why we think that the argument of Nagasawa and (...) Trakakis fails to overthrow our objection to sceptical theism. (shrink)

La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Los trabajos de este libro esperan problematizar este y otros ejes, explorando las perspectivas de los ?clásicos? de la escuela francesa en epistemología (Bachelard, Canguilhem, Althusser, Foucault, etc.), las relaciones entre los mismos y los diálogos que cabe establecer entre estos y otras corrientes de pensamiento. Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

En este trabajo analizamos la reivindicación gadameriana del valor cognitivo de arte como un ejemplo de un modo de conocimiento que permite concebir de mejor manera la comprensión que tiene lugar en las ciencias del espíritu. Dicha reivindicación presupone el desconocimiento del valor cognitivo del arte operado por la subjetivización de la estética con Kant y una vuelta a los presupuestos de la tradición humanista. Por ello en la introducción presentamos en esquema los conceptos humanistas de tacto, gusto, sentido común (...) y juicio y comparamos el concepto de experiencia que corresponde a los mismos con la noción de experiencia modelada por la ciencia moderna. En la primera parte del trabajo examinamos en detalle la subjetivización de la estética que comienza con Kant y culmina con la “conciencia estética”. En la segunda parte examinamos cómo la reivindicación del valor cognitivo del arte corre pareja con el desarrollo de una ontología de la obra de arte. Concluimos señalando cómo el recorrido realizado facilita la comprensión de la especificidad de las ciencias del espíritu (humanidades). (shrink)

The first part of this paper develops an outline of the history of hermeneutics organised around the problem of the method, understood as the question of guarantee of objectivity, the central problem of XIX century hermeneutics. In this outline XX century neo-Wittgensteinian philosophers like Peter Winch and Charles Taylor, appears as establishing the legitimacy of the methodological autonomy of hermeneutically oriented approach to social studies. Second part of the paper follows Georgia Warnke suggestion that specific Gadamerian contribution is to refuse (...) objectivity and intersubjective validity as necessary requisites for interpretation to be successful. We find in an analogy with phenomenological analysis of perception of material object and in hermeneutical analysis of the function of “distance” the grounds in Gadamer´s thought that supports this interpretation. We conclude assessing whether Gadamer position implies a methodological conclusion of the kind "everything goes" and which is the role intersubjectivity has to play in Gadamerian new scenery. In ‘Evil is Still Evidence: Comments on Almeida’ Robert Bass presents three objections to the central argument (ENE) in my ‘Evil is Not Evidence’. The first objection is that ENE is invalid. According to the second objection, it is a consequence of ENE that there can be no evidence for or against a posteriori necessities. The third objection is that, contrary to ENE, the likelihood of certain necessary identities varies with the evidence we have for them. In this reply (...) I explain why ENE has exactly none of the implications described by Bass. I argue in the concluding section that there is a modal solution to the epistemological problems presented by ENE. (shrink)

O sistema democrático é entendido por Norberto Bobbio em dois vieses: como um conjunto de regras de procedimento para a constituição do governo e para a formação das decisões políticas, isto é, a democracia formal; e a democracia substancial, a qual pressupõe um conjunto de fins ideais — igualdade jurídica, social e econômica — independentemente dos meios adotados para os alcançar. Essas noções distintas se complementam no conceito que o autor explicita, visto que o ideal igualitário que o inspira (democracia (...) como valor, substancial) se realiza somente na formação da vontade geral (democracia como método, formal). Esse sistema se estende por alguns objetivos, os quais buscam alcançar o resultado mais próximo de sua aspiração que, em um contexto pluralista, são: liceidade de dissenso; participação mais ampla das pessoas nos assuntos públicos por meio de associações, partidos, sindicatos, etc; e descentralização do poder em diversos polos, nos quais cada grupo encontrará sua identidade e representatividade. Contudo, em sua obra Liberalismo e Democracia (1994), Bobbio apresenta tais objetivos em uma perspectiva diferente, elencando as possíveis falhas em cada um desses. Um dos principais problemas afirmados por ele tange à incapacidade dos governos democráticos de dominarem convenientemente os conflitos em uma sociedade complexa e de atender às exigências dos cidadãos, resultando em um cenário de sobrecarga de demandas financeiras e sociais, falta de legitimação do poder central e conflitualidade entre este e a população. Posto isso, o presente trabalho se debruça sobre os principais pressupostos da democracia e seus possíveis efeitos negativos, isto é, os riscos de sua aplicação em demasia. Desta maneira, conduziremos nossa análise perpassando por esse problema para, ao final, elencarmos os fatores limitantes para uma melhor execução dos cânones democráticos. (shrink)

According to Paul Draper and Ryan Nichols the practice of philosophy of religion—and especially its theistically committed practitioners—regularly violate norms of rationality, objectivity, and impartiality in the review, assessment, and weighing of evidence. (Draper and Nichols, 2013). We consider the charge of epistemic partisanship and show that the observational data does not illustrate a norm-violating form of inquiry. The major oversight in the charge of epistemic partiality is the epistemically central role of prior probabilities in determining the significance of incongruent (...) evidence. We argue that reasonably divergent views on the likelihood of theism on incongruent evidence can also account for differences in significance. We conclude that it is an epistemic requirement that committed theists regard incongruent evils as much less significant evidence against theism than do lukewarm theists, agnostics, or atheists. Differences in the significance of evidence quite properly reflect differences in commitments to theism. (shrink)

É comumente aceito, atualmente, que Aristóteles não teria enfrentado ou tentado seriamente resolver o famoso paradoxo do mentiroso, embora ele tenha sido formulado por Eubúlides de Mileto, membro da escola megárica e rival filosófico de Aristóteles. No máximo, assim reza a visão tradicional, ele parece apenas fazer uma menção desse paradoxo nas Refutações sofísticas, Capítulo 25, talvez esboçando a sua solução. O meu intento, no presente artigo, é desafiar essa opinião geral mostrando que o Estagirita fornece uma explicação implícita para (...) duas versões do paradoxo do mentiroso, a saber, a versão autorreferencial (que pode ser apresentada pela declaração: “esta declaração é falsa”), e a versão anafórica (que pode ser apresentada por meio de duas declarações mutuamente referentes como estas: “a próxima declaração é verdadeira” e “a declaração anterior é falsa”). A minha alegação é que a solução aristotélica para essas duas versões do paradoxo encontra-se no núcleo de sua refutação de duas teses, as quais denominei como tese da synalethia (que defende que toda declaração é verdadeira) e como tese da sympseudia (que defende que toda declaração é falsa). Tal refutação é realizada no oitavo capítulo do quarto Livro da Metafísica, um texto até agora subestimado pelos intérpretes modernos, mesmo sendo a parte final de um dos mais importantes escritos de Aristóteles. A solução aristotélica, assim defendo, é levada a cabo por meio dos seguintes princípios: (i) toda declaração é sempre precedida por um operador de verdade da forma ‘é verdade que...’, ou seja, toda declaração, qualquer que seja o que ela possa declarar a mais, primariamente assevera a sua própria verdade; e, em conformidade com o princípio anterior, (ii) toda declaração que assevera a sua própria falsidade ou acarreta a verdade de sua contraditória é necessariamente falsa. Através desses princípios, a refutação de Aristóteles da synalethia e da sympseudia é bem-sucedida. Mostrarei que obtemos uma boa solução para as versões do mentiroso acima mencionadas (e implicitamente presentes nas posições refutadas), apenas aplicando esses mesmos princípios a elas. Esse tipo de solução ao mentiroso tanto quanto para as teses antes citadas é muito parecido com aquele explicitamente encontrado nas obras de diversos filósofos, a saber, Guilherme de Sherwood, Tomás Bradwardine, João Buridano, Alberto da Saxônia, Paulo Venetus, Charles S. Peirce e Arthur Prior. Assim, também defendo que essa linhagem tem as suas raízes na solução de Aristóteles. (shrink)

Intentaremos reconstruir la controversia acerca de la posibilidad de un lenguaje privado. Analizamos primero las posiciones “epistemológicas” (Malcolm y Fogelin), mostrando sus fallos. Luego analizamos la versión “semántica” (Kenny y Tugendhat) encontrándolas igualmente fallidas. La crítica de Barry Stroud a los argumentos trascendentales como argumentos antiescépticos nos permite discernir el presupuesto común que debilita las posiciones anteriores. Asimismo, la reconstrucción permite apreciar mejor la manera en la que la versión de Kripke evita comprometerse con este presupueto. Argumentamos que esta versión (...) es la única versión consistente del argumento. Esta afirmación obliga afrontar algunas de las objeciones corrientes dirigidas a la propuesta de Kripke: el problema de la objetividad de la regla, ¿puede un individuo estar acertado en contra de la opinión comunitaria consensuada?; y el problema de las relaciones internas entre reglas y casos, presuntamente violentada por el rol que la noción de acuerdo comunitario desempeña en la misma. Sostenemos que nuestra reconstrucción de la controversia permite encontrar razones para mostrar por qué las objeciones mencionadas no se le aplican. -/- This paper tries to reconstruct the controversy on the possibility of private language. First, we analyse “epistemological” trends in the argument (Malcolm, Fogelin) showing their failures. Then, we analyse “semantic” versions (Kenny, Tugendhat) finding they are also failed. Barry Stroud’s criticism of transcendental arguments as refutations of scepticism allows us to discern the common presupposition that weakens the versions of the argument considered. Moreover, this reconstruction allows us to see how Kripke’s deals with the problem of the previous discussion in order to avoid committing himself with this presupposition. We consider Kripke’s version to be the only consistent version of the argument. Such a statement obliges us to consider two of the most important criticisms directed against Kripke’s Wittgenstein: The problem of objectivity of the rule: Can a single individual be right in contradicting communal assent?; and the problem of internal relationships between rules and their applications, allegedly violated because of the role played by communal agreement. We claim that our reconstruction of the controversy provides good reasons to show that the above-mentioned objections don’t apply to Kripke’s Wittgenstein version. (shrink)
